What Is Burden Of Proof In Civil Law?

In a civil lawsuit, the burden of proof solely rests with the plaintiff in the case. In order to be successful in the lawsuit, the plaintiff needs to prove that the allegations are true and that the defendant is responsible for causing damages. The term preponderance of evidence comes into play here. Under the preponderance standard, the burden of proof is met when the party with the burden convinces the fact finder that there is a greater than 50% chance that the claim is true. The quality and verifiability of the evidence are key in meeting a burden of proof. The evidence should be "clear and convincing".

What is Clear & Convincing Evidence?

Clear and Convincing evidence refers to the legal standard that the evidence being presented must be highly and substantially more probable to be true rather than untrue. Also, the trier of fact needs to have a firm conviction or belief in its factuality. This standard is also used in some criminal cases.
