Factors To Consider With a Jury Trial

Attorney Gaskill and I rarely get a chance to go to trial. We collaborate on many cases daily, but rarely get the opportunity to conduct a jury trial together. Much of our civil practice is resolved through mediation, settlements, and alternative dispute resolution. Still, jury trials present very specific advantages and challenges. There are several factors to consider with a jury trial, some of which are detailed here.

Jury Trial Verdicts

We recently tried a case in Gwinnett State Court, and the outcome was a verdict in our client’s favor. It was a victory for our client and a significant multiple of the confidential amount offered by the opposing party before trial. When presented properly, jury trials can often lead to larger verdicts than settlements or mediation.  

Jury Diversity

From our experience, we have come to recognize that Gwinnett juries are smart, diverse, and conservative. Since the 2010 census, the jury pool is looking increasingly more diverse, with an increase in women jurors. In many instances, this diversity can help deliver a just and favorable outcome. We think that jury diversity helped us in the case mentioned above as well. 

Court Efficiency

Overall, the State Court of Gwinnett County is surprisingly efficient. For example, our case was called as the last one on the one-week calendar. We were in position 64, meaning that the Court disposed of 63 cases ahead of ours in just one week. It is rare for a State or Superior Court to be able to deal with that many jury trials in that short a time period. This means that as a trial attorney you have to be fully prepared and ready from the outset since your case may be called sooner than one may assume.
